Investment Portfolio for Shared Prosperity’s Privacy Policy

The Ministry of Economy (Secretaría de Economía), located at 189 Pachuca Street, Col. Condesa, Zip Code 06140, Cuauhtémoc Administrative District, Mexico City, and in accordance with Article 34 of the Organic Law of the Federal Public Administration (Ley Orgánica de la Administración Pública Federal), through its various administrative units, including the Productive Development Unit (Unidad de Desarrollo Productivo), is responsible for the use, processing, and protection of personal data collected through this registry; in doing so, it fully complies with the provisions of the General Law on the Protection of Personal Data Held by Obligated Entities (Ley General de Protección de Datos Personales en Posesión de Sujetos Obligados / LGPDPPSO) and other applicable regulations, as well as the principles of lawfulness, purpose, fairness, consent, quality, proportionality, information, and accountability set forth in said Law. For this reason, we hereby disclose the following policies based on current regulations applicable to the protection of personal data.

Object

This Privacy Policy explains how personal data collected through the registration form provided herein is processed and protected, assuring you that your personal data will be stored on secure platforms and processed in accordance with the provisions of Articles 3, sections I, II, III, IX, XI, XX, XXVII, and XXXI, 4, 6, 7, 16, 17, 18, 19, 20, 21, 22, 23, and 24 of the LGPDPPSO.

For what purposes will your personal data be collected?

We will use the personal data we collect for the following purposes, which are necessary for the activities of the Ministry of Economy:

  • To compile the files and databases needed to monitor the Portfolio for Shared Prosperity, as well as the obligations arising therefrom.
  • To publish aggregated data on a website, such as total investment nationwide and by state; jobs created and preserved nationwide and by state; as well as the aggregate number of challenges resolved by state, sector, and institution, although this list is not exhaustive.
  • Keep a historical database for statistical purposes.
  • Coordinate with the competent agencies to monitor the procedures submitted via the form, for which the following information shall be provided: company name, description of the challenge, file number or case number of the corresponding procedure, brief description of the impact, date of submission and expiration date of the procedure, and contact information.
  • Personal data is collected directly from the individual or legal entity making the request. The processing of your personal data requires your consent. As a general rule, consent for the processing of your personal data will be assumed, that is, when this Privacy Policy has been made available to you and you do not expressly object; therefore, express authorization for the processing of personal data will not be required, since by providing personal data for the purposes described, you tacitly authorize the Ministry of Economy, as well as the respective regulatory authority, to process your personal data in accordance with this Privacy Policy.

What personal data will be collected?

To fulfill the purposes described in this Privacy Policy and in accordance with the procedure to be carried out, the following personal data will be used, including but not limited to:

  • Personal data required from legal entities: company name or business name, Federal Taxpayer Registry number, name of the investment project, type of investment, state and municipality where the investment is located, economic sector and subsector of the project, country or countries of origin of the investment, number of company employees, number of direct and indirect jobs created, project status, and start and end years of the investment related to the project.
  • Personal data of individuals: name, position, and contact phone number or email address.
  • Likewise, the Ministry of Economy may request, via the registered email address, additional data and documents, subject to the same Privacy Policy, if necessary.
  • Transfer of personal data. Your personal data will not be transferred, disclosed, or distributed, except as indicated in this Privacy Policy, as well as in Article 16 of the LGPDPPSO, or in the event that there is express consent from you in writing or through a similar means of authentication.

How can you claim my ARCO rights?

You have the right to know what personal data you have provided to us, how we use it, and the terms under which we process it (Access). You also have the right to request the correction of your personal information if it is incomplete, inaccurate, inappropriate, or excessive (Rectification); to have it removed from our records or databases when you believe its processing violates the law or because it is no longer necessary for the fulfillment of the purpose or purposes of said database (Cancellation); as well as to object to the use of your personal data for specific purposes (Objection). These rights are known as ARCO rights. You may invoke your ARCO rights regarding the processing of personal data by submitting a written request to the Transparency Unit of the Ministry of Economy (Unidad de Transparencia de la Secretaría de Econom located at 189 Pachuca Street, Ground Floor, Condesa Neighborhood, Postal Code 06140, Cuauhtémoc Administrative District, Mexico City, Phone 55 57 29 91 00, extension 11005.

Changes to the Privacy Policy

Due to new legal requirements, administrative provisions, or other factors, this Privacy Policy may be modified, changed, or updated; in this regard, the Ministry of Economy (Secretaría de Economía) undertakes to keep you informed of any changes to this Policy through its website. However, each of the Administrative Units under the SE will provide you with a specific Privacy Policy, tailored to the nature of the particular procedure or service.
